Copyright Infringement 鈭 Policies and Sanctions (including Computer Use and File Sharing)

The College prohibits students from uploading, downloading, posting, publishing, transmitting, retaining, reproducing, sharing or distributing in any way information, software, movies, music, books, articles or any other material which is protected by copyright or other proprietary right, without obtaining permission of the owner. Violation of this policy may result in the termination of the student's access to the internet via the College鈥檚 internet system, and constitutes a violation of the Student Code of Conduct. Students should also be aware that unauthorized distribution of copyrighted material, including unauthorized peer-to-peer file sharing, may subject the student to civil and criminal liabilities. In general, anyone found liable for civil copyright infringement may be ordered to pay either actual damages or 鈥渟tatutory鈥 damages affixed at not less than $750 and not more than $30,000 per work infringed. For 鈥渨illful鈥 infringement, a court may award up to $150,000 per work infringed. A court can, at its discretion, also assess costs and attorneys鈥 fees. For details, see Title 17, United States Code, Sections 504, 505. Willful copyright infringement can also result in criminal penalties, including imprisonment of up to five years and fines of up to $250,000 per offense. For more information, please see the website of the US copyright office, especially their FAQs. Unauthorized peer-to-peer file sharing is a violation of law, as well as College policy. Students engaging in unauthorized peer-to-peer file sharing, including illegal downloading and unauthorized distribution of copyrighted materials, will be subject to disciplinary action up to and including suspension or dismissal from the College.

Federal Student Financial Aid Penalties for Drug Law Violations

The College will distribute to all enrolled students a notice regarding the drug and alcohol abuse prevention program, which explains that a student will become ineligible to receive Title IV Federal financial aid for a period following conviction for an offense under any Federal or State law involving the possession or sale of illegal drugs for conduct occurring during a period of enrollment during which the student received Title IV Federal financial aid.

Information for Crime Victims about Disciplinary Hearings

Upon written request, the College will disclose to the alleged victim of any crime of violence or a nonforcible sex offense, the results of any disciplinary proceeding conducted by the College against a student who is the alleged perpetrator of such crime or offense. If the alleged victim is deceased as a result of the crime or the offense, the information shall be provided upon written request to the next of kin of the alleged victim.
